On December 24, on the highway at 8th and Race Streets, Officer Gay, Smith and Casey were informed by Joseph Winn that a negro male they wanted was on the street. When Officer Gay attempted to place Carl Nolly, under arrest but he was shot once in the abdomen, causing his death. On January 7, 1927 Carl Nolly was found Guilty of 1st Degree Murder by Judge McDevitt and sentenced to death.
